Employers and their agents can easily file, save, and manage annual non-subscriber notices online and from any device, 24 hours a day. Employers can also use Employer E-File to report workplaces injuries, illnesses, and deaths as Texas Law requires.

In Texas, private employers can choose whether to provide workers' compensation insurance coverage.
Employers that choose not to provide Texas workers’ compensation coverage to their employees are known as non-subscribers. Those that decide to end their workers’ compensation insurance coverage also become non-subscribers on the date the policy ends.
Non-subscriber notices to workers
Employers that do not provide Texas workers’ compensation coverage must notify their workers by:
- Posting a notice of no coverage in the workplace in English, Spanish, and any other language as needed.
- Placing the notice where employees can see it regularly.
- Giving written notice of no coverage to new employees.
Non-subscriber notices to Texas Division of Workers’ Compensation
An employer who does not have Texas workers’ compensation insurance or that ends their workers’ compensation coverage must file the following notices to DWC.
- Notice of no coverage should be filed.
- Between February 1 and April 30 of each calendar year.
- After hiring the first employee.
- After terminating a Texas workers’ compensation policy.
- Report work-related injuries, illnesses, and deaths with more than one day of lost time.
- Required for employers with five or more employees.
- Due within one month and seven days from the date of death, knowledge of the work-related illness, or after lost time began.
