TO: ALL INSURANCE COMPANIES, CORPORATIONS, EXCHANGES, MUTUALS, RECIPROCALS, ASSOCIATIONS, LLOYDS, OR OTHER INSURERS LICENSED TO WRITE LIABILITY AND EACH POOL, JOINT UNDERWRITING ASSOCIATION, OR SELF-INSURANCE MECHANISM OR TRUST AUTHORIZED BY LAW TO INSURE ITS PARTICIPANTS, SUBSCRIBERS, OR MEMBERS AGAINST LIABILITY IN THE STATE OF TEXAS

RE: 2006 ANNUAL AGGREGATE CLOSED CLAIM REPORT 2006 CLOSED CLAIM RECONCILIATION FORM

The attached mandatory calls are being issued pursuant to §§38.151 - 38.163 of the Texas Insurance Code. The Annual Aggregate Closed Claim Report and instructions are adopted by reference in 28 Texas Administrative Code (TAC), Sec. 5.9202. The Closed Claim Reconciliation Form, affidavit, and instructions are adopted by reference in 28 TAC Sec. 5.9204.

The Acknowledgment of Receipt and Data Calls must be completed and returned in accordance with the instructions by no later than:

Failure to comply with the requirements of this call, within the time limits specified, may constitute violations of the Texas Insurance Code and may subject the insurer to the penalties provided by law.

The Closed Claim Report of Accepted Transactions, the Closed Claim Report of Unaccepted Transactions, the Closed Claim Report of Unusual Circumstances, and the Closed Claim Corrections/Suspect Errors Report are enclosed. These reports are not available through our Web page due to the confidentiality provisions of §§38.151 - 38.163 of the TIC. Copies of these documents are available by contacting TDI.
